Supremes Avoid Ruling on Constitutionality of Tax Credits
The Supreme Court issued a ruling today in the matter of Ohio's tax credit incentives. The Wall Street Journal's Law Blog summarizes the decision here:
In DaimlerChrysler v. Cuno, the Supreme Court passed on deciding on the constitutionality of state tax credits that incentivize corporations to do business in their states. Instead, the Court ruled that the taxpayers who had challenged the credit did not have “standing” to do so, so the federal trial court should not have ruled that the Ohio tax credits provided to DamilerChrysler were unconstitutional under the Commerce Clause.There is an AP story here as well.
